Criminal offenders may be offered to participate in voluntary rehabilitation programs aiming at correcting undesirable behaviour, as a condition of early release. Behavioural treatment may include direct intervention into the central nervous system (CNS). This article discusses under which circumstances voluntary rehabilitation by CNS intervention is justified. It is argued that although the context of voluntary rehabilitation is a coercive circumstance, consent may still be effective, in the sense that it can meet formal criteria for informed consent. Further, for a (...) consent to be normatively valid (“take the wronging out of the act”) under a coercive circumstance, the subject to be treated must (1) have the sovereign authority to consent, and (2) the offer-giver must be in the right normative position to make the offer. While I argue that subjects do have the sovereign authority to consent to treatment, I also argue that inappropriate offers yield invalid consents. Considerations on inappropriate offers should therefore inform which kinds of CNS intervention-based rehabilitation schemes the state may propose as part of the criminal justice system. Yet as I conclude in this paper, while there are some intrinsic constraints on voluntary rehabilitation programs, the main constraints on voluntary rehabilitation are likely to be contingent overriders. However, CNS intervention is not ruled out as such in the context of voluntary rehabilitation. (shrink)

ZusammenfassungIm Rahmen des Modellvorhabens „Patienten als Partner—Tumorpatienten und ihr Mitwirken bei medizinischen Entscheidungen“ wurden zwischen März 2002 und August 2003 272 palliativ behandelte Tumorpatienten nach ihrer Einstellung zur Patientenverfügung und zur gewünschten Beteiligung an medizinischen Entscheidungen befragt. Von den Befragten kannten 30% Patientenverfügungen nicht, darunter signifikant mehr Befragte mit formal niedrigerem Bildungsabschluss. Es hatten bereits 11% eine Patientenverfügung abgeschlossen, 22% wollten wahrscheinlich eine abschließen, und 30% wollten keine abschließen. Es fand sich ein statistisch signifikanter Zusammenhang zwischen dem Abschluss einer Patientenverfügung (...) und dem Wunsch nach mehr eigener Entscheidungsverantwortung. Die Einstellung zur Patientenverfügung und der Wunsch nach partizipativer Entscheidungsfindung stehen in keinem statistisch signifikanten Zusammenhang. Patienten mit schriftlichen Vorausverfügungen haben einen erhöhten Kommunikations- und Rückkopplungsbedarf, auf den Ärzte sensibel eingehen sollten. Bei der Information über Patientenverfügungen sollten Menschen mit niedrigerem Bildungsstand mehr als bisher berücksichtigt werden. (shrink)

This article represents conversations with the American composer Libby Larsen in which she described her beliefs about music, music education, and the dilemmas that our current system faces as we seek to provide relevant and meaningful music education to our students. Our conversation explores such topics as cognitive psychology, music theory, cultural practices and developments in American culture, and current music education practices. Larsen brought up many questions about music education in America, providing some suggestions for the future (...) and posing problems for which the solution may require a great deal of imagination by music education teachers. The article is structured as a Socratic dialogue, in which Larsen constructs an inductively strong argu- ment for making radical changes to current music education practice. (shrink)

–Whether celebratory or critical, STS research on science-industry relations has focused on the blurring of boundaries and hybridization of codes and practices. However, the vocabulary of boundary and hybrid tends to reify science and industry as separate in the attempt to map their relation. Drawing on interviews with the head of a research center in plant biology, this article argues that biology and biotech are symbionts. In order to be viable and productive, symbiosis needs to be carefully managed and given (...) room for divergence within mutual dependence. This process does not take place as the negotiation of a preexisting science-industry boundary. Rather, viability is obtained through a strategy of circumventing the science-industry food chain and sequestering biotech components within the research center. Symbiosis allows academic scientists to do biology while at the same time demonstrating entrepreneurial spirit. (shrink)

The power of algorithms has become a familiar topic in society, media, and the social sciences. It is increasingly common to argue that, for instance, algorithms automate inequality, that they are biased black boxes that reproduce racism, or that they control our money and information. Implicit in many of these discussions is that algorithms are permeated with normativities, and that these normativities shape society. The aim of this editorial is double: First, it contributes to a more nuanced discussion about algorithms (...) by discussing how we, as social scientists, think about algorithms in relation to five theoretical ideal types. For instance, what does it mean to go under the hood of the algorithm and what does it mean to stay above it? Second, it introduces the contributions to this special theme by situating them in relation to these five ideal types. By doing this, the editorial aims to contribute to an increased analytical awareness of how algorithms are theorized in society and culture. The articles in the special theme deal with algorithms in different settings, ranging from farming, schools, and self-tracking to AIDS, nuclear power plants, and surveillance. The contributions thus explore, both theoretically and empirically, different settings where algorithms are intertwined with normativities. (shrink)

The notion of quality features prominently in contemporary discourse. Numerous ratings, rankings, metrics, auditing, accreditation, benchmarking, smileys, reviews, and international comparisons are all used regularly to capture quality. This book paves the way in exploring the socio-political implications of evaluative statements, with a specific focus on the contribution of the concept of quality to these processes. Drawing on perspectives from the history of ideas, sociology, political science and public management, Dahler-Larsen asks what is the role of quality, and more (...) specifically quality inscriptions, such as measurement? What do they accomplish? And finally, as a consequence of all this, does the term quality make it possible to deal with public issues in a way that lives up to democratic standards? Revisionists claim that the retributive intuitions informing our responsibility-attributing practices are unwarranted under determinism, not only because they are false, but because if we are all victims of causal luck, it is unfair to treat one another as if we are deserving of moral and legal sanctions. One revisionist strategy recommends a deflationary concept of moral responsibility, and that we justify punishment in consequentialist rather than retributive terms. Another revisionist strategy recommends that we eliminate all concepts of guilt, blame and (...) punishment, and treat dangerous criminals as we treat people with contagious diseases. I argue against both strong and moderate revisionism that it is not unfair to hold persons desert -entailingly responsible insofar as they take an interest in being treated as appraisable, and that it is unfair to persons not to treat them as desert -entailingly responsible contrary to their interests in being treated as such. The interest-based argument, I conclude, give us a justification for communicating retributive attitudes, but may still require a weak revision of our retributive practices, in the direction of a communicative theory of punishment. The aim of this paper is to contribute to the discussion of expertise and skilled movement in sport by analysing the bodily practice of learning a new movement at a high level of skill in parkour. Based on Sennett’s theory of craftsmanship and an ethnographic field study with experienced practitioners, the analysis offers insight into the skilful, contextual and unique practice of parkour, and contributes to the renewed discussion of consciousness in sport at a high level of skill. With Sennett’s (...) concept of craftsmanship, it is possible to describe and grasp important aspects of obstacles put up, repetitions and material consciousness in developing perceptual and physical skills in parkour. The parkour craftsmen conduct a constant dialogue between concrete, material practices and thinking. It is argued in the article that Sennett’s ideas about craftsmanship are, in many ways, similar to Dreyfus and Dreyfus’ concept of mastery, but are less elitist and exclusive than the theory of skill acquisition... This book is a history of the relationship between the discipline of anthropology and the Christian faith. It explores how leading anthropologists have come to believe that ethnographic findings and evidence made Christianity no longer tenable.

Theories of the structure of affect make competing predictions about whether people can feel happy and sad at the same time. Considerable evidence that happiness and sadness can co-occur has accumulated in the past 15 years, but holes in the case remain. I describe those holes and suggest strategies for testing them in future research. I also explore the possibility that the case may never be closed, in part because the competing hypotheses may not be entirely falsifiable. Fortunately, hypotheses need (...) not be falsifiable to be useful. Research on mixed emotions has been generative and the body of research will continue to shed light on the structure of affect. This article takes the stance that the subjectivity of the researcher is an integral part of the research process. It should be studied as a key to understanding the interrelational processes of meaning in an interview situation. The article demonstrates how the subjectivity of the researcher can be made accessible methodologically and methodically by combining a psychodynamic approach with an autoethnographic approach. The methodical question is therefore how the researcher can conduct introspection and at the same time reflect upon and (...) analyse the central object of investigation. The approach is psychoanalytically informed, but autoethnography became the actual vehicle for moving beyond reflections on the psychodynamics represented in the texts. The researcher ventured into an introspection of not only the texts, but also her own feelings, fantasies, and bodily experiences at the time of the interview and also when bringing the data into new situations. The abstract reflections after the interview situation were left for a while, and instead a more experiential and sensual/bodily understanding appeared, based on narratives, feelings, and reflections from the research field. In doing so, the affective and experiential personal process became an important step in the interpretation. (shrink)

This letter addresses the editorial decision to publish the article, “Research on group differences in intelligence: A defense of free inquiry” (Cofnas, 2020). Our letter points out several critical problems with Cofnas's article, which we believe should have either disqualified the manuscript upon submission or been addressed during the review process and resulted in substantial revisions.

This article defends three claims. First, that collection and division in the Phaedrus are described as procedures that underlie human speaking and thinking in general, as well as philosophical inquiry, and are not identified with either. Second, that what sets the dialectical use of these procedures apart from their ordinary use are philosophical suppositions independent of the procedures of collection and division themselves; for that reason, collection and division cannot be identified with dialectic as such. Third, that the second part (...) of the Phaedrus is concerned with the broader question how noble or beautiful speaking, in general, may be said to depend on dialectic as much as it is concerned with the question how rhetoric, as a kind of expertise, is related to dialectic. We define an evolutionary process of “economic Darwinism” for playing the field, symmetric games. The process captures two forces. One is “economic selection”: if current behavior leads to payoff differences, behavior yielding lowest payoff has strictly positive probability of being replaced by an arbitrary behavior. The other is “mutation”: any behavior has at any point in time a strictly positive, very small probability of shifting to an arbitrary behavior. We show that behavior observed frequently is in accordance with “evolutionary equilibrium”, (...) a static equilibrium concept suggested in the literature. Using this result, we demonstrate that generally under positive (negative) externalities, economic Darwinism implies even more under- (over-)activity than does Nash equilibrium. (shrink)

The 1948 constitution of the World Health Organization (WHO) defines health as ‘a state of complete physical, mental and social well-being and not merely the absence of disease or infirmity’. It was a bold and revolutionary health idea to gain international consensus in a period characterized by fervent anti-communism. This article explores the genealogy of the health definition and demonstrates how it was possible to expand the scope of health, redefine it as ‘well-being’, and overcome ideological resistance to progressive and (...) international health approaches. The first part of the article demonstrates how the health definition was composed through a trajectory of draft ideas from scholars in the history of medicine, as well as political actors working to promote national health insurance. The definition was authored by League of Nations veteran Raymond Gautier, but secretly drew heavily on medical historian Henry E. Sigerist’s controversial book Socialized Medicine in the Soviet Union (1937). The second part analyses how it was possible to resist the ideological pushback against the WHO and secure US ratification. The WHO’s progressive constitution was not simply a deviation from dominant health ideas, but a direct outcome of the entrenched health conflict. The genealogy is based on original archival material from international organizations and US government archives. The article contributes to understandings of the political controversies surrounding the WHO and to scholarship on understandings of health. It also illustrates how influential health ideas cross the boundaries between politics and health sciences, as well as the boundaries between domestic health policy and global health. (shrink)

Recent debates in psychopathy studies have articulated concerns about false-positives in assessment and research sampling. These are pressing concerns for research progress, since scientific quality depends on sample quality, that is, if we wish to study psychopathy we must be certain that the individuals we study are, in fact, psychopaths. Thus, if conventional assessment tools yield substantial false-positives, this would explain why central research is laden with discrepancies and nonreplicable findings. This paper draws on moral psychology in order to develop (...) tentative theory-driven exclusion criteria applicable in research sampling. Implementing standardized procedures to discriminate between research participants has the potential to yield more homogenous and discrete samples, a vital prerequisite for research progress in etiology, epidemiology, and treatment strategies. The article is by Nathan Cofnas and is entitled “Research on group differences in intelligence: A defense of free inquiry” (2020). The purpose of our letter is not to invite Cofnas’s contribution into a broader dialogue, but to respectfully voice our concerns about the decision to publish the manuscript, which, in our opinion, fails to (...) meet a range of academic quality standards usually expected of academic publications. We may correctly say that Søren Kierkegaard is one of the most influential Christian-religious thinkers of the modern era, but are we equally justified in categorizing his writings as foundationally religious? This paper challenges a prevailing exclusive-theological interpretation that contends that Kierkegaard principally writes from a Christian dogmatic viewpoint. I argue that Kierkegaard’s religion is better understood as an outcome of his philosophical analysis of human nature. Conclusively, we should appreciate Kierkegaard first as a philosopher, whose aim is the explication (...) of human subjectivity, and not primarily as an orator of Christian orthodoxy. (shrink)

Hernandez et al.’s review provides clear evidence that positive affect can contribute to well-being and fits nicely within the positive psychology framework. The emergence of positive psychology has been valuable for understanding well-being, but I suggest that a balanced psychology can prove even more valuable in the years to come. A balanced psychology requires giving as much attention to negative emotion as to positive emotion. It also requires considering whether there are circumstances in which positive emotions can be detrimental and (...) negative emotions can be beneficial. Along those lines, evidence reviewed here indicates that healthy coping with severe stressors involves experiencing a combination of positive and negative emotions. (shrink)

Pepper Culpepper’s seminal Quiet Politics and Business Power has revitalized the study of when business elites can shape policies away from public scrutiny. This article takes the concept of quiet politics to a new, and surprising, set of actors: trade union leaders. Focusing on the case of Denmark, it argues that quiet politics functions through political elite networks and that this way of doing politics favors a particular kind of corporatist coordination between the state, capital, and labor. Rather than showing (...) macrocorporatist coordination between the two classes and governments, it identifies representatives of business and labor that hold privileged positions in political elite networks. Representatives of segments are found in industries important for the Danish economy, specifically, the exporting manufacturing sector. Being at the core of the network requires not only a key position in the Danish economy but also an understanding that politics is often done best without politicians and voters. The analysis shows that trade union and business association representatives work closely on a wide number of issues through quiet politics, using their extensive network to broker and foster agreement between different stakeholders.
